====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-08-2024 Heard learned counsel for the petitioner and the State.
2. Petitioner seeks bail in a case registered for the offence punishable under sections 396, 397, 398 and 302 of the Indian Penal Code and section 27 of the Arms Act.
3. As per the prosecution case, all the FIR named accused persons and 3 to 4 unknown miscreants, variously armed, attacked the Customer Service Point (CSP), and snatched bag containing cash from the CSP operator. Accused persons also made firing in which husband of the informant died on the spot, whereas CSP operator sustained injury on his hand.
4. Learned counsel for the petitioner submits that as per FIR, petitioner is not the assailant of the deceased and he is only alleged to have caused fire arms injury in the
Patna High Court CR. MISC. No.12085 of 2024(5) dt.09-08-2024 2/2 hand of the CSP operator. Petitioner claims clean antecedent. Charge sheet has already been filed. Petitioner is in custody since 21.7.2023.
5. Learned counsel for the State opposes the prayer for bail.
6. Considering the aforesaid facts of the case, prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I Naugachia, Bhagalpur in Bihpur (Bhawanipur) Police Station Case No. 389 of 2023.
