The petitioner is accused in connection with Udwant Nagar P.S. Case No. 136 of 2015 registered under Sections 341, 323, 324, 325, 307, 379, 354(A), 504 and 506/34 of the Indian Penal Code.
The accusation is that in course of occurrence, Sunil Yadav, gave Garasa blow at the head of Brij Mohan Singh, father of the informant, causing blood injury when he fell down then this petitioner took Garasa from Sunil Yadav and again gave injury at his head.
Learned counsel for the petitioner submits that it would appear from the F.I.R. that there is specific allegation against accused, Sunil Yadav to gave Garasa blow at the head of Brij Mohan Singh, father of the informant, thereafter this
Patna High Court Cr.Misc. No.1042 of 2016 (3) dt.19-02-2016 petitioner took the Garasa from the hand of Sunil Yadav and cause injury but Amrendra Kumar Singh, brother of the informant, has specifically stated that Sunil Yadav had given Garasa blow at the head of the deceased.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhajpur at Arrah in connection with Udwant Nagar P.S. Case No. 136 of 2015.
