Petitioner being the husband of the daughter of the informant has renewed his prayer for bail is languishing in custody since 25.03.2013 in a case registered for the offences punishable under Sections 498A, 323, 302 of the Indian Penal Code.
Accusation is of killing his two and half months daughter since she was sleeping in the night. The informant is the wife of the petitioner.
It is submitted by the learned counsel for the petitioner that during fight between the petitioner and his wife the child fell down from the lap of petitioner's wife, as a result she died.
Considering the nature of accusation and the
Patna High Court Cr.Misc. No.56884 of 2015 (5) dt.17-10-2016 report of the Senior Superintendent of Police, Gaya dated 3rd October, 2016 that all prosecution witnesses have been examined and statement of accused under Section 313 Cr.P.C. has been recorded, this Court is not inclined to grant bail to the petitioner in connection with Imamganj P.S. Case No. 35 of 2013, pending in the court of learned Ad-hoc Additional Sessions Judge-II, Gaya.
Accordingly, the bail application is dismissed. It is expected that learned trial court will conclude the trial expeditiously.
