The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 399, 402, 120B of the Indian Penal Code and 25(1-B)a, 26, 35 of the Arms Act.

On information that miscreants are preparing to commit 'dacoity', a raid was led when two persons, namely, Amit Kumar Shukla and Dhrmendra Kumar, sitting in the Bolero vehicle, were apprehended. Subsequently, from the possession of Amit Kumar Shukla one loaded country made pistol, five cartridges and a mobile phone were recovered. The apprehended co-accused suggested the name of the petitioner and others as his associates and disclosed that they kept the looted articles in the

Patna High Court Cr.Misc. No.2704 of 2016 (2) dt.18-01-2016 2/2 house of co-accused Anil Rai and the petitioner. It is submitted by learned counsel for the petitioner that neither the petitioner has been apprehended on the spot, nor anything has been recovered from his possession and for the same incident Lalganj P.S. Case No.51/2015 was also registered under sections 414 and 120B IPC in which the petitioner is also an accused. Apart from that the petitioner is not accused in any other case.

Considering the nature accusation against the petitioner it is a case for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Lalganj P.S. Case No.50/2015, pending before the learned CJM, Vaishali at Hajipur.

With the above observation, this application is, accordingly, disposed off.
