JUSTICE BIRENDRA KUMAR ORAL ORDER 28-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 25(1-B)a, 26/35 of the Arms Act. A country made loaded pistol was allegedly recovered from the possession of this petitioner. Submission is that the petitioner is accused in a case under Sections 457 and 390 of the Indian Penal Code otherwise he has got no criminal antecedent. Search and seizure was not made according to requirement of Section 100 Cr.P.C. Considering the entire facts, let petitioner, above named, be enlarged on bail, after completion of nine months in custody, on furnishing bail bond of Rs.10,000/-(Ten Thousand)

Patna High Court Cr.Misc. No.12789 of 2017 (3) dt.28-03-2017 with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur/Successor Court, in connection with Hajipur Town P.S. Case No.875 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
