JUSTICE BIRENDRA KUMAR ORAL ORDER 18-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 302/201/120B/34 of the Indian Penal Code and Section 27 of the Arms Act.
The petitioner is named in the F.I.R. only on suspicion. The deceased had left the house along with co-accused Satish Yadav. Thereafter dead body of the deceased found in the next morning.
Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate,
Patna High Court Cr.Misc. No.18290 of 2017 (2) dt.18-04-2017 2/2 Madhepura/Successor Court, in connection with Madhepura P.S. Case No.778 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
