JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-06-2017 Heard learned counsel for the petitioner and State. The petitioner is accused in Beur P.S. Case No. 216 of 2016 (S.Tr. No. 850/2016) for offences under Sections 498(A) and 364 of the Indian Penal Code and Sections 3 / 4 of the Dowry Prohibition Act.

From the tenor of FIR it appears that the daughter of the informant was married with the petitioner on 22nd April, 2015 and after marriage the daughter of the informant was extended inhuman treatment by the family members of the petitioner and there was demand of dowry. The informant apprehended that his daughter was eliminated. In this case vide order dated 20th April, 2017 case diary was called for from the court of Additional Sessions JudgeIX, Patna. Patna High Court Cr.Misc. No.17441 of 2017 (3) dt.01-06-2017 2/2 submits that the victim is still traceless.

Counsel for the petitioner submits that the petitioner is in custody since 13th September, 2016. The other co-accused, namely, mother-in-law, father-in-law, sister-in-law and brotherin-law have been granted bail by this Court in Cr. Misc. 54443 of 2016 vide order dated 1.3.2017, Cr. Misc. No. 6854 of 2017 vide order dated 6.3.2017 and Cr. Misc. No. 14317 of 2017 vide order dated 29.3.2017.

Having regard to the facts and circumstances mentioned above, the statements made in para-3 of the bail petition that the petitioner has no criminal antecedent and the period of custody, I am inclined to enlarge the petitioner, above named, on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-IX, Patna in connection with Sessions Trial No. 850 of 2016 arising out of Beur P.S. Case No. 216 of 2016, subject to the condition that the petitioner will extend full co-operation in the case and will not, in any manner, influence the witnesses.
