JUSTICE BIRENDRA KUMAR ORAL ORDER 19-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 498A and 365 of the Indian Penal Code.

The wife of the petitioner is allegedly missing and allegation is that the petitioner used to torture her for nonfulfillment of demand of dowry. Submission of the petitioner is that children are still with the petitioner. The wife has voluntarily left the house. Investigation is already complete and charge-sheet has been submitted against the petitioner under Sections 498A and 365 of the Indian Penal Code.

Patna High Court Cr.Misc. No.12787 of 2017 (4) dt.19-04-2017 Considering the facts and circumstances specially the fact that the petitioner is only person to take care of his minor children, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Manvendra Mishra, the learned Judicial Magistrate, Nalanda at Biharsharif/Successor Court, in connection with Deepnagar P.S. Case No.223 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
