The petitioner seeks bail in K. Hat (Maranga) P.S. case No. 201 of 2003 under Section 395 of the Indian Penal Code. The learned counsel for the petitioner submits that petitioner is not named in the FIR. The name of petitioner figured in the case in the confessional statement of co-accused, Mazloom, who has already been acquitted by order and judgement passed in Sessions Trial No. 39 of 2005. It is submitted that there is absolutely no further evidence and the petitioner surrendered in the court on 17.02.2017. The petitioner has already remained in jail for two and half months.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond

Patna High Court Cr.Misc. No.20464 of 2017 (2) dt.03-05-2017 2/2 of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in K. Hat (Maranga) P.S. Case No. 201 of 2003.
