Petitioner seeks bail in a case registered for the offences punishable under Sections 489(A), 489(B), 489(C), 420 and 120(B) of the Indian Penal Code.
Petitioner was found in possession of Rs.4,00,000/- (Rupees Four Lacs) counterfeit Indian currency. Submission is that the petitioner has got no such criminal antecedent and is in custody since 08.08.2018. Investigation of the case is already complete. There is no material in the case diary that currency note was to be used by the petitioner as genuine, rather the petitioner was simply a carrier at the instance of one Birendra Kumar. Considering the facts aforesaid, especially
Patna High Court CR. MISC. No.12475 of 2019(3) dt.19-06-2019 2/2 completion of investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Kotwali Police Station Case No.505 of 2018, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
