15-02-2016 After some argument, Sri Manoj Kumar, learned counsel for the petitioner, in presence of Sri Anand Kumar Ojha, learned counsel for the respondent/South Bihar Power Holding Co. Ltd., makes a prayer for disposal of the writ petition with a direction to the Executive Electrical Engineer, Electrical Supply Division Danapur, Khazpura, Patna/respondent no. 5 to take final decision in respect of request for new electric connection. He has submitted that the petition was filed initially before the Assistant Electrical Engineer, however; since no action was taken, then he

Patna High Court CWJC No.5554 of 2014 (2) dt.15-02-2016 2/2 filed application before the Executive Engineer, vide Annexure 2/b to the writ petition.

Normally, in such dispute, it was not appropriate for this court to interfere with the matter, but since a limited prayer has been made for disposal of the writ petition, the Court is proposing to dispose of the writ petition with an observation that if the petitioner files a fresh application in accordance with the Electricity Act before the respondent no. 5/ Executive Electrical Engineer, Electrical Supply Division Danapur, Khazpura, Patna regarding new electric connection within a period of six weeks from today. The Executive Electrical Engineer may examine the same and pass appropriate order in accordance with law preferably within a period of two weeks from the date of filing of such application.

The writ petition stands disposed of.

It goes without saying that the Court has not at all recorded any opinion on merit of the case.
