Heard the learned counsel for the petitioners and learned APP for the State through video conferencing. The petitioners apprehend their arrest for the offences alleged under Sections 27(a), 27(b), 27(c), 28, 28(a), 30(a), 30(b), 30(c) and 36 AC of Drugs and Cosmetic Act, S. 20(b) and 23(b) of NDPS Act and S. 274, 275, 276, 248, 379, 406, 413, 414, 419, 420, 468, 120B of of the Indian Penal Code, registered in connection with Drugs Special Case No. 1/2018.

Patna High Court CR. MISC. No.19882 of 2021(2) dt.24-01-2022 2/3 At the outset, the learned counsel for the petitioners has submitted that for the same and one occurrence two cases have been lodged. First was Pirbahore P.S.Case No. 264 of 2017 and the second is the present one lodged by Drug Inspector Dr. Sachidanand Prasad. The petitioners were granted anticipatory bail in Pirbahore P.S.Case No. 264 of 2017, vide composite order dated 03.11.2017 passed in Cr.Misc. No. 38480 of 2017 and Cr.Misc. No.47318 of 2017. The learned 1st Additional Sessions Judge, Patna in his order dated 21.12.2020, considering all these aspects, have granted anticipatory bail to other accused persons on the similar ground, but the anticipatory bail of the petitioners was rejected vide order dated 23.09.2020.

Considering the fact that for the one and the same occurrence, two cases have been lodged and in one case the petitioners have been granted anticipatory bail, as mentioned above, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs.
