2. After some arguments, learned senior counsel seeks permission to withdraw the anticipatory bail application on behalf of petitioner no. 4 namely Nitish Kumar.

3. Permission is accorded.

4. Accordingly, the prayer for bail application is dismissed as withdrawn on behalf of petitioner no. 4

5. So far as the petitioner nos. 1, 2, 3 and 5 are

Patna High Court CR. MISC. No.10812 of 2025(2) dt.28-03-2025 2/3 concerned, apprehends their arrest in connection with Khanpur P.S. Case No. 275 of 2024, registered for offences under Sections 109, 126 (2), 115(2), 308(3), 118(1), 303(2), 117(2), 352, 351 (2), 3 (5) of the B.N.S.

6. As per prosecution case, petitioner nos. 1, 2, 3 and 5 are alleged to have assaulted the informant and also petitioner no. 1 snatched Rs. 25,000/- from his pocket. Co-accused Madan Prasad Yadav assaulted with sword on the head of informant.

7. Learned counsel for the petitioners submit that petitioners have falsely been implicated in this case. There is general and omnibus allegation levelled against these petitioners.

8. Learned APP for the State opposes the prayer for bail.

9. Considering the aforesaid circumstances, this application for anticipatory bail is allowed with regard to petitioner nos. 1, 2, 3 and 5.

10. Accordingly, let the petitioner nos. 1, 2, 3 and 5, above-named, in the event of their arrest or surrender within four weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction

11. The petitioner nos. 1, 2, 3 and 5 will mark their attendance at Khanpur Police Station on every Sunday of each month. Any default in appearance at the local Police Station will result into cancellation of their bail bond.
