JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 30-05-2017 Heard learned counsel for the petitioner and the State.

The petitioner is accused in connection with Mokama P.S. Case No. 26 of 2016 for the offence under Section 25(1-B)a, 26 and 35 of the Arms Act.

The petitioner is in jail since 02.02.2016. From perusal of Annexure-2, it appears that co-accused Shambhu Paswan @ Shambhu @ Samrat Paswan was granted bail by this Hon'ble Court on 20.08.2016 passed in Criminal Miscellaneous No.34263 of 2016.

Having regard to the period of custody and the fact that similar circumstance other co-accused was granted bail by this Court on 20.08.2016 passed in Criminal Miscellaneous No.34263 of 2016. Let the petitioner, above named, is directed to

Patna High Court Cr.Misc. No.21034 of 2017 (2) dt.30-05-2017 2/2 be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of ACJM, Barh in connection with Mokama P.S. Case No. 26 of 2016 on the condition that the petitioner shall cooperate in the trial and will not in any manner influence the evidence or the witnesses.
