JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-05-2019 Petitioner seeks bail in anticipation of his arrest in connection with Sursand P.S. Case No. 141 of 2018, registered for the offences punishable under Sections 498A, 341, 323, 504 and 506 of the Indian Penal Code.

Allegation against the petitioner is of assaulting the informant with respect to demand of dowry and also trying to set her on fire.

Submission of learned counsel for the petitioner is that the whole allegation is false and concocted and he is still ready to keep her with him with dignity and care.

Heard learned APP and learned counsel for the informant, who has no objection in residing with the petitioner if she is allowed to live with dignity and care as earlier also petitioner had taken her

Having heard both sides and in the facts and circumstances, let petitioner, above named, surrender on 15.5.2019 before the court below and on that opposite party No.2 shall also remain present in court and on filing a petition on affidavit by the petitioner that he is ready to keep her with dignity and care and will not make any torture on her, he will be released on provisional bail for a period of nine months and the court below will watch their conduct and marital relationship by calling them in court in first week of every month and once the court is satisfied with their conduct and marital relationship, specially the conduct of the petitioner, his bail bond shall be confirmed, otherwise the court below is free to pass any other order(s) as it may deem fit and proper, including cancellation of bail bonds of the petitioner. With the above observation, this application is disposed of.
