JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-03-2020 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in connection with Bahera P.S. Case No. 277 of 2019 for the offence under Sections 420, 467, 471 and 406 of the Indian Penal Code. Allegation against this petitioner is that he is availing the benefit of old age pension scheme, although he is not qualified for such pension.

Learned counsel for the petitioner, with reference to voter list, submits that the petitioner is qualified for grant of old age pension.

Considering the fact that the issue of verification of age relates to verification of records which has not been done in the present case, the Court is inclined to grant bail to the petitioner, in the event of arrest or surrender within four weeks

Patna High Court CR. MISC. No.10751 of 2020(3) dt.04-03-2020 2/2 from today, on furnishing bail bond of Rs.50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Benipur in connection with Bahera P.S. Case No. 277 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
