ANJANA MISHRA ORAL ORDER 08-04-2016 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. The petitioner is apprehending his arrest in connection with Laxmipur P.S. Case No. 59/2015 registered for the offences punishable under Sections 302, 120(B), 34 and 427 of the Indian Penal Code and under Section 27 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is not named in F.I.R nor is there any specific allegation against him. It is further submitted that the allegation of firing on the deceased is at the hand of one Bibhuti Pandey and not this petitioner.

Learned counsel appearing on behalf of the state after perusal of the case diary submits that there is no further material in

Patna High Court Cr.Misc. No.3337 of 2016 (3) dt.08-04-2016 the case diary, so as to raise suspicion against this petitioner. Considering the aforementioned facts and circumstances of the case, let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Jamui in connection with Laxmipur P.S. Case No. 59/2015 subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjana Mishra, J.) Amit/- U T
