JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Alauli P.S. Case No. 165 of 2016, registered under Section 364, 302, 120(b)/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that nine persons named in the F.I.R., including the petitioner, who is notorious criminal wanted in several cases, came at the door of the informant and started to carry her husband Rajesh Yadav. On which informant made request to Ramanad Yadav, leader of the group, to set free her husband, but he started to abuse saying that if anyone will come to save then he would loss his life. On alarm, other villagers came then accused persons felt difficulty to carry her

Patna High Court Cr.Misc. No.7347 of 2017 (2) dt.09-03-2017 2/2 husband then on the order of Ramanand Yadav, Dharmbir Yadav shot fire at the temporal region of her husband, who died on the spot.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to village dirty politics. Further submission is that there is specific allegation against co-accused Ramanand Yadav on whose direction Dharmbir Yadav shot fire at the husband of the informant. Further submission is that petitioner is accused in four cases out of which, he has been acquitted in three cases and in one case he is on bail. The petitioner is in custody in the present since 09.08.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in connection with Alauli P.S.
