The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 414 of the Indian Penal Code and Sections 25(1-B)a, 26 of the Arms Act. As per prosecution case, the petitioner was apprehended on the spot and from his possession total 4,29,920/- Rs. cash, 8 live cartridges and 32 mobiles phones were recovered.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He has got no criminal antecedent. The petitioner has no concern with the alleged

No.10481 of 2023(4) dt.08-08-2023 2/2 eight live cartridges rather he was a mobile repairer and he was going to open his new startup business of second hand mobiles, hence for this purpose the aforesaid in-operative mobiles were collected and to meet out his business expenses he had arranged such fund from his relatives. It is further submitted that the petitioner is languishing in judicial custody since 01.12.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail after framing of charge, if not framed. The above named petitioner is directed to be released on bail in connection with Patrakar Nagar P.S. Case No. 779 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M.-Ist Class, Patna.
