11-12-2015 Heard Sri Ashok Kumar, learned counsel for the petitioner and Smt. Rita Verma, learned Addl. Public Prosecutor. The petitioner, who is in custody in Tekari P.S. Case No. 212 of 2014 registered for the offence under Section 302 of the Indian Penal Code and Section 27 of the Arms Act, 1959, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that F.I.R. was lodged against unknown on recovery of dead-body and subsequently, wife and other relatives of the deceased have come forward as eye-witness and alleged that the petitioner was also one of the member of the accused persons. However, allegation has been made against co-accused Dasrath Yadav and Santosh Yadav regarding opening fire in the occurrence.

No.52805 of 2015 (2) dt.11-12-2015 2/2 In view of the facts and circumstances, particularly the fact that F.I.R. was lodged against unknown after recovery of dead body, the Court considers it a fit case for grant of bail. Let the petitioner namely Suresh Yadav be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Jigar Shah, Judicial Magistrate, Ist Class, Gaya/concerned court in connection with Tekari P.S. Case No. 212 of 2014. (Rakesh Kumar, J.) Anay/ U T
