The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 379, 385, 427, 504, 506/34 of the Indian Penal Code.
The prosecution case is that the accused persons were ploughing the paddy crop land of the informant. Though the tractor of petitioner no. 1, Suresh Yadav,
Patna High Court Cr.Misc. No.2957 of 2016 (2) dt.19-01-2016 which being driven by petitioner no. 3 Amit Yadav @ Amit Kumar Yadav. It is alleged that petitioner no. 2 Pramod Yadav and petitioner no. 4 Jitendra Yadav started assaulted the informant and took away Rs.1,000/- from the pocket of the informant. It is further alleged that petitioner no. 1 Suresh Yadav forcibly took the L.T.I. of the informant on the blank paper and the shirt pocket of the informant was torn and informant was pushed on the ground. It is alleged that the accused persons resorted to fire. The accused persons also demanded Rs.25,000/- as extortion and it was threatened that until it is paid the informant will not be allow to plough the land. The land in question belonged to petitioner share. In the background of land dispute accusation has been levelled. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.
Considering the accusation in the background of land dispute and for the occurrence of 02.08.2015 the First Information Report was registered on 06.08.2015, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Sri Nagar P.S. Case
