JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-02-2019 This is an application for grant of anticipatory bail in connection with Atri P.S. Case No. 328 of 2018, disclosing offences under Sections 341, 323, 307, 379, 504, 506, 34 of the Indian Penal Code.
Allegation against the petitioners is of assault to the informant by rod and lathi causing injury.
Submission of learned counsel for the petitioners is that the whole allegation is false and concocted and as a matter of fact, there was a dispute with respect to irrigation of land and furthermore, in spite of investigation, no final opinion has been brought on record about the nature of injury, which will appear from the impugned order itself.

Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M, Gaya, in connection with Atri P.S. Case No. 328 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
