JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 06-07-2022 Learned counsel for the petitioner is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under section 302 and 34 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, the petitioner and the coaccused persons are said to have shot the brother of the informant, namely Rajbahar Yadav while he was sleeping on the roof of the Community Building adjacent to Bhagwati Sthan. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in

Nothing has been recovered from the conscious possession of the petitioner. The petitioner has two criminal antecedent as stated at para 3 of the bail petition, which is not of similar nature. There is general and omni bus allegation against the petitioner. The petitioner is in custody since 16.08.2021.

Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Khagaria Muffasil Police Station Case No. 323 of 2020, with a following conditions :-

1. One of the bailors must be the close relative of the petitioner.

2. The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner will liable to be cancelled.

3. If the petitioner is found involved in any other criminal case in future, his bail bond will liable to be cancelled. The application stands allowed.
