====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-05-2023 Heard learned counsel for the petitioners and the State.

Petitioners apprehend arrest in a case registered for the offences punishable under Sections 304(B), 498A of the Indian Penal Code.

As per prosecution case, all FIR named co-accused persons along with these petitioners committed torture and killed the daughter of the informant by pressing her neck due to non-fulfillment of demand of dowry.

Learned counsel appearing for the petitioners submits that the petitioners are co-villagers of the husband of the

Patna High Court CR. MISC. No.10913 of 2023(2) dt.15-05-2023 2/2 deceased and have falsely been implicated in this case. Allegation against them is general and omnibus. They are separate in mess and property and are not concerned with the family affairs of the deceased and her husband. Petitioners have got clean antecedent.

Learned counsel for the State vehemently opposes the bail application.

Considering the aforesaid facts and circumstances, let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Basantpur P. S. Case No. 313 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
