JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-03-2017 The application is for grant of regular bail in connection with Jamui P.S. Case No. 292 of 2016 for the offences under sections 419, 420 and 379 of the Indian Penal Code. It has been submitted on behalf of the petitioner that he has earlier moved before this Court for grant of regular bail and this Court, vide order dated 27.01.2017 passed in Cr. Misc. No. 54142 of 2016, rejected the prayer for bail of the petitioner with observation that he may renew his prayer for bail once the charges are framed in this case and now the charge has been framed, which is apparent from Annexure-3 to the supplementary affidavit and the petitioner is in custody since 10.11.2016. Heard learned A.P.P. also.

Having heard both sides, in view of the facts and

Patna High Court Cr.Misc. No.9756 of 2017 (3) dt.29-03-2017 2/2 circumstance, let the petitioner be enlarged on bail on furnishing bail bond of Rs. 25,000/-(Rs. Twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case No. 292 of 2016 subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court and further subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine rhyme or reasons, the prosecution will have liberty to move for cancellation of his bail.
