====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 04-10-2018 Heard learned counsel for the petitioner and counsel for the State.

In this case, learned counsel for the petitioner submits that the petitioner has qualified in the preliminary test as well as mains examination. As per advertisement, for E.B.C., the height was prescribed as 162 CM. The petitioner is short by 0.3 CM and makes a prayer that sympathetic consideration be taken and he should be appointed.

Already the petitioner is working as a Home Guard. This Court is not giving any opinion on the merit of the case. Let the authority should examine the grievance of the petitioner

Patna High Court CWJC No.15803 of 2018(2) dt.04-10-2018 2/2 and will take a decision in accordance with law within a period of three weeks from the date of receipt/production of a copy of this order.

The authority while considering the grievance of the petitioner will take into account the representation of the petitioner annexed as Annexure-4 to this writ application. With the aforementioned observation and direction, this writ application is disposed of.
