Petitioner apprehends arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
It is alleged that the petitioner and other accused persons surrounded the informant's wife and asked about his younger son and on denial, the petitioner took knife from his waist and hurled knife injury on her head resulting into her death in the way to IGIMS, Patna.
Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case due to village politics. FIR has been lodged after delay of 18 days without explanation. Petitioner has got no criminal antecedent. Learned counsel for the State opposes the prayer for bail submitting that there is specific allegation of giving fatal
Patna High Court CR. MISC. No.11267 of 2020(2) dt.22-06-2020 2/2 blow to the victim on the petitioner.
In view of the nature of allegation, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered on its own merit without prejudice.
