Petitioner apprehends his arrest in a case instituted under Sections 302/120(B) of Indian Penal Code.

It is alleged that while the informant along with deceased Shankar Ram were going to catch Sadbhawan Express for Patna, one, Abbas Mian fired which later hit on his head. Petitioner submits that two more persons are named in the F.I.R. as accused and he has been cited as a witness. He submits that the police has submitted charge-sheet against him on mere suspicion. There is no material evidence to show that the petitioner was involved in killing of the deceased.

Having regard to the facts and circumstance of the case, in case of arrest/surrender, let the petitioner named above, be

Patna High Court Cr.Misc. No.57296 of 2015 (4) dt.16-03-2016 2/2 released on bail on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each, to the satisfaction of learned Railway Judicial Magistrate, Railway Court, Bettiah, West Champaran, in connection with Raxaul Rail P.S. Case No. 12 of 2012.
