JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-02-2017 The petitioner is in custody since 30.08.2016 in connection with Sangrampur P.S. Case No. 99 of 2016, registered for offences punishable under Sections 302/34 of the Indian Penal Code.

It has been submitted on behalf of petitioner that save and except suspicion, there is nothing against the petitioner. It is further submitted that informant suspected that as her grand-father stopped the petitioner from coming to his house and, for that, grand-father had been murdered by petitioner and others. It is also submitted that there is no eye-witness to the said offence and other co-accused having similar allegation has already been granted bail by this Court vide order dated 16.01.2017 passed in Criminal Miscellaneous No. 55518 of 2016 and the petitioner has been in

Patna High Court Cr.Misc. No.4271 of 2017 (2) dt.13-02-2017 2/3 judicial custody since 30.08.2016 Heard learned A.P.P. also. Learned A.P.P. has opposed the prayer for bail Having heard both sides. From perusal of record, it appears that petitioner has been implicated in this case on mere suspicion and for that he is in custody for about four months and also other co-accused of this case has already been granted the privilege of regular bail. As such, the bail application of petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/-(Rs. Twenty five thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. II, Munger in connection with Sangrampur P.S. case no. 99 of 2016, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event
