2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act 2016.
3. As per the prosecution case, 04.860 liters of Nepali liquor was recovered from the seized motorcycle.
4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner claims clean antecedent.
5. Learned APP for the State submits that the
Patna High Court CR. MISC. No.11567 of 2025(2) dt.21-03-2025 2/2 petitioner is involved in the business of illicit liquor and he is owner of the seized motorcycle.
6. Considering the recovery of illicit liquor from the seized vehicle and the fact that petitioner is owner of the seized vehicle, this pre-arrest bail petition is dismissed. (Prabhat Kumar Singh, J) Ranjeet/- U T
