JUSTICE BIRENDRA KUMAR ORAL ORDER 12-04-2017 Heard learned counsel for the petitioner, learned counsel for the informant and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 341/324/307/302/34 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner was member of the unlawful assembly and allegation is of commission of death. The main allegation of commission of fire-arm injury is on co-accused Md. Khurshid Ansari.

Learned counsel for the informant opposed the prayer on the ground that petitioner and other family members were members of the unlawful assembly carrying the same

Patna High Court Cr.Misc. No.12923 of 2017 (3) dt.12-04-2017 2/2 liability, which the main assailant was.

Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 5th Additional Sessions Judge, Bhagalpur/Successor Court, in connection with S.T. No.37 of 2017, arising out of Jagdishpur P.S. Case No.169 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
