Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 21-04-2022 Heard Mr. Anil Kumar Singh, learned advocate for the petitioner no.2 and learned Additional Public Prosecutor representing the State.

The petitioner no.2/Ganesh Pandit seeks bail in anticipation of his arrest in connection with Nagarnausa P.S. Case No. 161 of 2020 dated 05.11.2020 instituted for the offences under Sections 341, 323, 307, 379, 504/34 of the Indian Penal Code.

According to the accusation in the F.I.R., the main accusation of assault is on co-accused Manish Kumar who has been arrested and has been released on bail by the court below.

Patna High Court CR. MISC. No.20356 of 2021(3) dt.21-04-2022 2/2 The Informant and others appear to have been injured but most of them have received only simple injuries. There is a counter version of the occurrence also in which three of the persons from the side of the petitioner no.2 has received injuries.

Considering the submission on behalf of the petitioner no.2/Ganesh Pandit that he is not alleged to have injured anybody in the occurrence and taking into account that there is a counter version of the occurrence also and that the petitioner no.2/Ganesh Pandit has no criminal antecedent, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Nagarnausa P.S. Case No. 161 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) rishi/- U T
