2. The petitioner seeks regular bail in connection with NDPS Case No.153 of 2024, arising out of Rail Muzaffarpur P.S. Case No.171 of 2024 lodged under Sections 8, 20(b)(ii)(b) of the NDPS Act, which is pending before Sessions Judge-cumSpl. Judge, Muzaffarpur.

3. Learned counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 03.10.2024 passed in Cr. Misc. No.71831 of 2024 with a liberty that he may renew his prayer for bail after framing of charge.

4. Learned counsel for the petitioner further submits

Patna High Court CR. MISC. No.11451 of 2025(3) dt.16-05-2025 2/3 that the petitioner's antecedent is clean and he is in custody since 19.06.2024. Counsel further submits that charge has been framed in this case on 18.11.2024 but no prosecution witness has been examined till date.

5. Learned APP for the State opposes the prayer for bail and submits that a report regarding present stage of the trial was called for and total 10.400 Kg ganja has been recovered, as per the prosecution, it transpires to this Court that this case is relating to District- Muzaffarpur, GRPS.

6. Speedy trial is a constitutional vision of justice. For this reason, the Superintendent of Police, Railway Muzaffarpur, is directed to take necessary action by instructing the concerned SHO/IO to assure the appearance of witnesses for adducing evidence in connection with NDPS Case No. 153 of 2024 arising out of Rail Muzaffarpur P.S. Case No. 171 of 2024 at the earliest, so that the trial may be concluded within six month from the date of production of the order.

7. The Registry is directed to transmit a copy of this order to the Superintendent of Police, Railway Muzaffarpur through fax, e-mail or any other mode forthwith. The Registry is further directed to handover a copy of this order to learned A.P.P. who shall communicate this order to the Superintendent of Police, Railway Muzaffarpur at his level.

8. In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to grant bail to the petitioner. Therefore, the bail application of the petitioner is hereby rejected.
