JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 395 of the Indian Penal Code. Earlier the prayer for bail of the petitioner was rejected by this court but submission on behalf of the petitioner is that having similar allegation, co-accused, Lal Babu Mukhiya and Yodha Mukhiya @ Ram Ayodhya Mukhiya have already been granted privilege of bail by this Court and moreover, there is no substantive progress in the trial of the petitioner which is evident from perusal of report of learned trial court itself. Considering the aforesaid facts and circumstances as

No.58040 of 2015 (3) dt.09-03-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-XI, East Champaran, Motihari in connection with Sessions Trial No. 77 of 2015 arising out of Chiraiya P.S. Case No. 81 of 2013.
