While the informant Chandradeo Mandal, Upendra Mandal @ Laddu Lal Mandal were passing through the house of Jagdish Mandal, at that very time Ram Kumar Mandal @ Balkaran Mandal was standing at his house who, seeing them, gone inside and came out armed with a pistol and then shot at causing instantaneous death of Upendra Mandal. Then it has been narrated that the petitioner Jai Narayan Mandal @ Rudal fired from his rifle over Upendra Mandal which caused injury over his nose. Named large number of persons to be the member of unlawful assembly who made indiscriminate firing and during course thereof, Suresh @ Kharkhun aimed at the informant having narrow escape. Patna High Court CR. MISC. No.8574 of 2020(4) dt.02-06-2020 2/2 Surendra Mandal, son-in-law of Ram Khelawan Mandal arrived alongwith three unknown associates and fired indiscriminately. Being nominated as a Panch relating to a land dispute amongst Jagdish Mandal and Shivchandra Mandal has been shown to be the motive. Apart from improbability coming out from the written report itself as, the deceased had already died before firing made by the petitioner, postmortem report also falsifies the allegation as only corresponding injury over the chest has been found over the deceased.

Thus, the petitioner, Jai Narayan Mandal is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M. VI, Supaul in Pipra P.S.Case No. 292/2018.
