The petitioner seeks bail in Bhargama P.S. case No. 139 of 2015 under Section 363, 366 of the Indian Penal Code. The informant alleged that his daughter had gone to bank to withdraw money but she did not return. The informant named the petitioner that he kidnapped his daughter for the purpose of marriage.

The learned counsel for the petitioner submits that the victim made her statement under Section 164 of the Cr.P.C. and she disclosed her date of birth as 09.11.1995. She further disclosed that petitioner assured her to marry but the petitioner disclosed that he was married earlier then she did not agree to marry with the petitioner thereafter petitioner left her to her house.

Patna High Court Cr.Misc. No.11661 of 2017 (3) dt.28-03-2017 2/2 Considering the facts that victim appears to be a major and she voluntarily went along with the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-III, Araria in S.T. No. 693 of 2015, arising out of Bhargama P.S. Case No. 139 of 2015.
