JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-08-2021 As prayed for, let the learned counsel appearing for the petitioner remove the defect(s), as pointed out by the office, within four weeks of starting of the Court proceeding in physical mode in normal course.

Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with Gaya N.D.P.S. Case No. 44 of 2019, arising out of Excise Case No. 375 of 2019, registered under Sections 20(b) of the N.D.P.S. Act and Section 56(b) of the Bihar Prohibition and Excise ct, 2018(amendment) Act, pending in the court of learned Additional Sessions Judge-XI-cum-Special Judge, NDPS Act, Gaya.

No.20119 of 2021(2) dt.04-08-2021 2/2 Learned counsel for the petitioner submits that the prayer for bail of the petitioner was earlier rejected on merit vide order dated 18.01.2020 passed in Cr. Misc. No. 86784 of 2019 by this Court. Further submission is that while the petitioner is in custody since 28.06.2019 but the trial of the petitioner is not concluded up till now.

Taking into consideration the recovery 100 KG Ganja from the vehicle, which was being driven by the petitioner, I am not inclined to reconsider the prayer for bail of the petitioner. Accordingly, the prayer for bail of the petitioner stands rejected. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
