2. In the present case, the petitioner is apprehending his arrest in connection with Mufassil (Mahadeva OP) P.S. Case No. 624 of 2023, registered for the alleged offences under Sections 413, 414/34 of the Indian Penal Code.

3. As per prosecution case, co-accused was apprehended with stolen motorcycle and he disclosed the name of the petitioner as the person who used to assist them in committing theft of motorcycles.

4. The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case merely on suspicion. The name of the petitioner was

No.14153 of 2024(2) dt.12-03-2024 2/3 disclosed by the co-accused in his confessional statement and apart from that there is no material against the petitioner to connect him with the offence as alleged. The petitioner is a driver of an ambulance and due to some dispute with the coaccused, he has named the petitioner in the present case. The petitioner has got no criminal antecedent.

5. Learned APP opposes the submission made on behalf of the petitioner.

6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the absence of material against the petitioner to show his involvement and further considering the remoteness of allegation as well as his clean antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court concerned within a period of eight weeks from today, be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Mufassil (Mahadeva) P.S. Case No. 624 of 2023, subject to the conditions mentioned in Section 438(2) of the Cr.P.C. and the following conditions:

(i) One of the bailors will be a close relative
