In the present case, the petitioner is seeking bail in connection with Sarsi P.S. Case No.38 of 2014 corresponding to Sessions Trial No.825 of 2014, registered for the offence punishable under Section 302 of the Indian Penal Code but chargesheet has been framed against the petitioner under Section 304(B) and 302 of the Indian Penal Code.
The petitioner has earlier moved before this Court in Criminal Miscellaneous No.10906 of 2015 for bail and this Court vide order dated 26.6.2015 rejected the bail application of the petitioner.
This Court had called for the case dairy. Paragraph
Patna High Court Cr.Misc. No.57074 of 2015 (4) dt.24-02-2016 2/2 Nos. 12, 15, 16, 17, 25 and 30 describes the nature of death received by the victim.
This Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, the Trial Court is directed to conclude the trial as early as possible preferably within a period of one year from today. The prosecution is direction to ensure the production of the witnesses, so that the trial may be completed within the aforesaid period. (Shivaji Pandey, J) pawan/- U
