The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act.

As per the prosecution case, on a raid being conducted, 100 litres of Mahua liquor was recovered from the house of the petitioner and he was taken into custody.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession or his house. He has been falsely implicated in the case. He is in custody since 28.12.2020 and has no criminal antecedent. Chargesheet has been submitted in the case. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and

No.20588 of 2021(2) dt.30-09-2021 2/2 taking into consideration the facts and circumstances of the case, the period in custody for over 9 months, not having any criminal antecedent together with chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Athmalgola P.S. Case no.315 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna, District Patna.
