1. The present petition has been filed for modifying the order dated 22.05.2023, passed in Cr. Misc. No.1273 of 2023 to the extent that the time granted to the petitioners for surrendering before the Ld. Court of C.J.M., Banka in connection with Banka P.S. Case No.368 of 2018, be extended by a further period of three weeks from today.

The learned counsel for the petitioner has submitted that on account of the order of this Court dated 22.05.2023 being not communicated to the petitioners in time by the counsel for the petitioners on account of lack of communication between the parties, the time granted to the petitioners to surrender before the Ld. Trial Court has lapsed, however it is submitted that the petitioners undertake to surrender before the

Trial Court within a period of three weeks from today for availing the privilege of anticipatory bail, thus, it is submitted that a sympathetic view be taken and the time granted to the petitioners to surrender before the Ld. Trial Court and obtain the privilege of anticipatory bail be extended by a further period of three weeks from today.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioners and taking into account the averments made in the present petition, I deem it fit and proper to extend the time already granted to the petitioners, vide order dated 22.05.2023, to surrender before the Ld. Court of Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No.368 of 2018, for the purposes of being admitted to the privilege of anticipatory bail, by a further period of three weeks from today.

4. Accordingly, the present petition stands disposed off with the aforesaid modification in the order dated 22.05.2023, passed in Cr. Misc. No.1273 of 2023, however, the rest of the order dated 22.05.2023 shall remain as it is. (Mohit Kumar Shah, J) sonal/- U T
