JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to be an order-giver but having more or less similar allegation, co-accused, Md. Sharif and some others have already been granted privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 14.08.2015 passed in Cr. Misc. No. 32114 of 2015. Moreover, the alleged occurrence is said to have taken place on account of childish quarrel and it was co-accused, Md. Sajjad who gave fatal blow to the deceased.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.56934 of 2015 (2) dt.17-12-2015 2/2 two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Katihar in connection with Sessions Trial No. 268 of 2015 arising out of Falka P.S. Case No. 18 of 2015.
