JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2020 Petitioner seeks bail in connection with Asthawan P.S. Case No. 166 of 2019, registered for the offence punishable under Section 395 of the Indian Penal Code.
Petitioner is not named in the FIR and allegation is of looting away the truck and snatching of 70-80 thousand rupees cash, mobile and keys of the vehicle.
Submission of learned counsel for the petitioner is that he has been made accused in this case on the basis of confessional statement of co-accused and he has been remanded from another case and he is in custody since 6.8.2019 and in spite of that he has not been put on T.I. parade. Heard learned APP, who has opposed the prayer for bail on the ground that petitioner is accused in seven other cases also.

No.8642 of 2020(2) dt.27-02-2020 2/2 Considering the submission as made above, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Nalanda at Biharsharif, in connection with Asthawan P.S. Case No. 166 of 2019, G.R.No. 4341 of 2019 on the condition that he has to appear before police station of his local area in second week of every month for a period of nine months or till conclusion of trial, whichever is earlier, so that police may watch his conduct and if his active involvement in such type of cases is found in future, prosecution is at liberty to move for cancellation of his bail bonds.
Let this order be communicated to the Superintendent of Police, Nalanda for needful.
