JUSTICE AHSANUDDIN AMANULLAH ORAL ORDER 10-01-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor, for the State.
2. The petitioner seeks bail in Mansi P.S. Case No. 162 of 2015 dated 31.07.2015 instituted under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.
3. This is the second attempt for bail as earlier such prayer was rejected by order, dated 07.06.2016 in Cr. Misc. No. 24953 of 2016.
4. Learned counsel for the petitioner submitted that on 06.06.2016 charges have been framed but there has not been much progress. For the reasons recorded in the previous order dated 07.06.2016 and also taking note of the fact that there has been no change in the intervening circumstances, except for passage of time, as the petitioner is also accused of firing in the neck region and the post mortem corroborating one wound on the upper back of neck, the Court is not inclined to enlarge the petitioner on bail.
5. Accordingly, the application stands dismissed.
6. However, the Court below shall expedite the trial
Patna High Court Cr.Misc. No.18108 of 2017 (2) dt.10-01-2018 2/2 and conclude the same latest by 31st July, 2018. It is indicated that the trial Court shall exercise all powers vested in it to ensure that the time fixed by this Court is adhered to. For the said purpose, the Court may even conduct the trial on a day-to-day basis, if so required.
7. Registry shall communicate the order to the trial Court, through fax also, latest by tomorrow, for strict compliance. (Ahsanuddin Amanullah, J) SA/- U
