====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 21-02-2019 Heard learned counsel for the petitioners and the State.

The petitioners seek bail in Murliganj P.S. Case No. 429 of 2018, instituted for the offence under Section (s) 341, 323, 307, 379, 504 and 506/34 of the Indian Penal Code. Counsel for the petitioners submits that altercation had taken place for payment of amount of fertilizer which has been purchased by the petitioners from shop of the informant. The instant case is counter blast of Murliganj P.S. Case No. 430 of 2018 filed by the petitioners side against the informant and others.

It is alleged in the written report that petitioner No. 2 assaulted the informant with sharp cutting weapon on his head

Patna High Court Cr.Misc. No.10404 of 2019(2) dt.21-02-2019 2/2 and petitioner No. 1 took out cash of Rs.85,000/- from the Galla of the informant.

The injury report of brother of the informant has been enclosed as Annexure-3 wherein the Doctor has found one incised wound on right side of scalp measuring 1 1⁄2" x 1/4"x skin deep which is simple in nature.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Murliganj P.S. Case No. 429 of 2018, in connection with learned Chief Judicial Magistrate, Madhepura, subject to the condition that both the bailors will be the close relatives of the petitioners.
