Petitioner is languishing in custody since 16.01.2017 in connection with POCSO Case No. 01/2017, arising out of Saur Bazar (Patarghat O.P.) P.S. Case No. 23/2017 for offences punishable under Sections 354, 354(A) of the Indian Penal Code and Sections 10, 12 of the POCSO Act. The prosecution case, as lodged by the uncle of the victim Rani Kumari, aged about 15 years, is that while she goes to her Coaching Centre in the morning, petitioner along with one other, passes indecent remarks against her. It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and has
Patna High Court Cr.Misc. No.15566 of 2017 (2) dt.12-04-2017 2/2 falsely been implicated in the aforesaid case, as both the petitioner side and the informant side are on inimical terms. However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge 1st cum Special Judge, Saharsa, in connection with POCSO Case No. 01/2017, arising out of Saur Bazar (Patarghat O.P.) P.S. Case No. 23/2017, subject to the condition that the petitioner will appear before the learned court below on each and every date and failure to appear on two consecutive dates without assigning any reason will entail cancellation of his bail bonds.
