Mr.Lalan Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 12-03-2024 Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State.

2. The petitioners apprehend their arrest in connection with Patahi P.S. Case No. 294 of 2023, registered for the offences punishable under Sections 147, 341, 323, 448, 354, 307, 379, 504 and 506 of the Indian Penal Code.

3. As per allegation, the accused persons including the petitioners came at the door of the informant and assaulted her. Petitioner no. 1 assaulted her with dabiya on her head, as result of which, he sustained injuries. Thereafter, they snatched gold

Patna High Court CR. MISC. No.13342 of 2024(2) dt.12-03-2024 2/2 chain worth Rs. 80,000/- from her neck.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in the present case. They are the persons of clean antecedents.

5. Considering the fact that there is specific allegation against the petitioner no. 1, Shashi Kumar to assault the informant, who suffered sharp cut injury on upper part of left temporal region, which is a vital part, hence the petitioner no. 1 does not deserve the privileges of anticipatory bail and accordingly, his prayer for bail is rejected.

6. So far as petitioner nos. 2, 3, 4, 5, 6, 7 and 8 are concerned, in the event of their arrest or surrender, within four weeks from today, he is directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran in connection with Patahi P.S. Case No. 294 of 2023, subject to condition as laid down under section 438(2) Cr. P.C.
