The petitioner is accused in connection with Gaurichak P.S. Case No. 67 of 2015 registered under Section 304(B)/34 of the Indian Penal Code.
The prosecution case is that Kajal Devi, grand daughter of informant, was married to Rahul Kumar before two years. The grand daughter of informant was being tortured for demand of money due to that reason Kajal Devi was taken her Maika by the informant. After executing the bond on 11.05.2014 by accused to keep the victim, grand daughter of informant, with full dignity and honour, she was taken to her matrimonial house (Sasural). On 15.04.2015, informant received information about
Patna High Court Cr.Misc. No.57657 of 2015 (3) dt.19-02-2016 killing of his grand daughter, Kajal Devi.
Learned counsel for the petitioner submits that petitioner is the father-in-law of the deceased and has falsely been implicated in this case due to ulterior motive. It is further submitted that it would appear from paragraph 25 of the case dairy that the bound about keeping the victim with full dignity and honour was executed by Rahus Kumar, husband of the deceased, who is already in custody. It is further submitted that petitioner is in custody since 22.04.2015.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Patna City, Patna, in connection with Gaurichak P.S. Case No. 67 of 2015. Out of two sureties, one surety must be the close relative of the petitioner.
