JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-03-2022 Heard learned counsel for the petitioner and the State. Prayer for bail of this petitioner was earlier rejected by this court vide order dated 07.09.2021 passed in Cr. Misc. No. 22004/2021.

Petitioner has renewed his prayer for bail on the ground that similarly situated co-accused, Sushil Kumar @ Sushil Kumar Kamat and Devendra Kamat have already been granted bail by a co-ordinate Bench of this court and petitioner is in custody since 12.09.2020.

Learned counsel appearing for the State opposes the prayer for bail and submits that case of petitioner is quite different and distinguishable on facts as on the basis of disclosure made by this petitioner looted articles were recovered but in case of those accused who have been granted bail there was no recovery on

Patna High Court CR. MISC. No.10537 of 2022(2) dt.23-03-2022 2/2 their disclosure.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is again rejected.
