The petitioner has prayed for regular bail in a case registered for the offence punishable under section 4(B) of the Explosive Substance Act.

As per allegation in FIR, on 19.7.2022 while the informant was sitting at her door, in the meantime, the accused persons including the petitioner came on a motorcycle towards the chowk and they threw a bomb at her door and fled away. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner has falsely been implicated in this case by the informant due to save the skin of her husband Lalan Sahni and

Patna High Court CR. MISC. No.11120 of 2023(2) dt.20-04-2023 2/2 others lodged by co-accused Baiju Kumar Sahni in connection with Sarai P.S. Case No. 221 of 2022 and this fact is mentioned in para-9 of the petition. It is further submitted that there no as alleged occurrence took place and no any objectionable material has been recovered from possession of the petitioner to show his complicity in this case. Moreover, the petitioner is languishing in judicial custody since 3.1.2023.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sarai P.S. Case No. 231 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XVIth, Vaishali at Hajipur.
